These Terms of Use ("Terms") govern your access to and use of theupscale.app, available at theupscale.app and as a mobile app for Android and iOS (together the "Platform", the "Service"), operated by Naanjil Technologies Private Limited ("we", "us", or "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service you represent that you meet this requirement and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
You may use the Service solely for your personal, non-commercial educational purposes. You agree not to:
Certain features of the Service require a paid Pro plan, and each test series is a separate one-time purchase. Prices are shown before you pay. We may change prices with reasonable notice; a change never affects a purchase already made, and for a renewing subscription it applies only from the next renewal after you have been told. All fees are non-refundable except as required by applicable law or as stated in our Refund Policy.
Bought on the website. Pro plans bought on theupscale.app are paid for the period chosen (a month or a year) and are processed by Razorpay. A plan marked as auto-renewing renews at the end of each period until you cancel it from your profile; cancelling stops the next charge and leaves your access in place until the period ends. A plan not marked as auto-renewing simply ends when its period does.
Bought in the mobile app. Purchases made inside the app are billed by the app store you use (Google Play on Android, the App Store on iOS) at the price shown in the store, and are subject to that store's terms. A Pro subscription bought in the app renews automatically, monthly or yearly as chosen, unless you cancel it at least 24 hours before the end of the current period, in the store's subscription settings (Google Play → Payments and subscriptions → Subscriptions, or App Store → Subscriptions). Cancelling stops the next renewal and leaves your access in place until the period ends. Refunds for store purchases are handled by the store under its refund policy.
A plan or a test series is tied to the account it was bought on and cannot be transferred to another account or person. The Service is not affiliated with, endorsed by, or connected to the Union Public Service Commission or any government body.
All content on the Service — including text, questions, study material, graphics, logos, and software — is owned by or licensed to us and is protected by copyright and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service or its content beyond the limited licence to use the Service for personal educational purposes.
If you submit any content to the Service (such as feedback or comments), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with operating and improving the Service. You represent that you have the right to grant this licence and that your content does not infringe any third-party rights.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.
The Service is intended to supplement — not replace — official UPSC study materials. We make no guarantee regarding examination outcomes or results.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL NAANJIL TECHNOLOGIES PRIVATE LIMITED, ITS AFFILIATES, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Naanjil Technologies Private Limited and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your infringement of any third-party right.
The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties. Upon termination, all licences granted to you will immediately cease. Provisions that by their nature should survive termination will do so, including Sections 5, 7, 8, 9, and 13.
We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
